Dealing With The Repercussions Of A Family Member’s Death

It is an unfortunate fact that many families in Georgia have to deal with the loss of a loved one due to a tragic accident or mistake. At Garland, Samuel & Loeb, P.C., we have talked to many clients who were devastated by the untimely death of a family member. Whether the person who was lost was a child in a drunk driving crash or an elderly relative who was not cared for properly in a nursing home, the pain and grief can be overwhelming.

There are many reasons the negligence or carelessness of another can result in a wrongful death claim. These may include:

  • Medical malpractice – doctor errors or medical team miscommunication that result in a missed diagnosis, medication mix-up, surgical mistake or other error leading to the death of a patient
  • Automobile accidents – drunk, distracted, aggressive or reckless driving that lead to a fatal car, motorcycle, bicycle or pedestrian accident
  • Truck accidents – drowsy or distracted commercial truck drivers who cause a deadly accident
  • Defective products – dangerous toys or defective consumer products that malfunction or break, causing death
  • Premises liability – fatal slip-and-falls, dog bites or other accidents on personal property
  • Nursing home abuse – physical abuse or neglect by nursing facility staff that can lead to fatal bedsore infections, malnutrition, dehydration and physical injuries

The death of a loved one causes more than just emotional anguish. When the person who died is a spouse or parent, the surviving family must often deal with the long-term loss of income. There are also medical and funeral expenses to contend with. In a wrongful death claim, the loss of companionship and lessened quality of life may also be considered. We realize that when a family member dies, your ability to heal can be greatly impacted by financial stress, and we strive to make sure you are taken care of.
