Birth Injury Leaves Baby Girl With Permanent Brain Damage

The thought of a birth complication resulting in damage to a baby is one of the worst thoughts to prospective parents in Georgia. Whether naturally occurring or through some form of doctor negligence or other medical malpractice, no new mother or father is truly ever ready to face such situations. Sadly, mistakes during labor and delivery do happen and often leave long-term consequences for the children and their families.

Such is the case for a Georgia family that recently filed a medical malpractice lawsuit against the hospital, doctor and midwife that were involved in the birth of their baby in September 2011. Meconium from the baby’s intestinal system can sometimes make its way into the amniotic fluid, leaving the infant at risk for respiratory problems and requiring either an immediate Caesarian section or an amnioinfusion to dilute the meconium, keeping mother and baby safe.

In this recent case, meconium was present but the amnioinfusion was not promptly ordered or performed. The mother was known to have a high-risk pregnancy with a poor chance of success with a vaginal delivery yet the family asserts that the medical team failed to perform the needed C-section for several hours. By the time the doctor did perform the C-section, the baby girl was in such distress that the suit claims she suffered personal injury that has left her with permanent brain damage. The family is seeking compensation that includes out of pocket medical expenses, pain and suffering, special education services and more.

A doctor error or negligence during the birth process can quickly result in such life-long circumstances and leave families mourning what could have been. While nothing can reverse such results, it can be helpful for families in such situations to consult with an attorney to understand their rights for protection or compensation.
